Big Brother is Alive and Well in America

Who ever would have believed that the such a powerful informational tool as the Internet, would be the exact tool used by those with malevolent intentions to watch, regulate and control United States citizens.

In the past few weeks, we have had a large number of emails and questions from non-customers (who never place orders) who all ask the same question, "Does Black Hawk Tobacco Shop except orders on-line?"

Considering that we have had to recently justify our payment system, it does take an overly paranoid person to know where these questions are coming from and for what purpose.

Even though this web site is for the private use of our shop customers (and anyone else using it is doing so against our Terms of Service policy), it is necessary to make a general statement concerning this issue.

Cigarettes are legal to buy and smoke, even in America

As anyone who has ever gone into a supermarket, gas station, Walmart or any convenience store knows, it is not yet illegal to purchase cigarettes or tobacco products. Cigarettes are legal to buy, own and smoke.

It is also totally legal for a person to buy cigarettes or tobacco products in any one of these establishments and pay for them with a Visa, Mastercard, Discovery, American Express or any other credit card or debit card. Hundreds of thousands of people do it every week.

That means - credit card sales of tobacco and cigarette products are legal in every 7-11, Circle K, Gas Station, Supermarket, or other convenience type store in the United States and the current attack is directed solely at Native American owned tobacco shops and establishments.

Who We are and What We Sell

The Black Hawk Tobacco Shop is a rather well established tobacco shop located in Palm Springs. We are one of the best known and busiest tobacco shops, if not the busiest, in the entire Coachella Valley. We have a continuous stream of walk in customers from the moment we open our doors at 9 AM until we close them again at 7 PM. Almost all of these customers do what customers do in every store in the country when buying cigarettes, they purchase using either credit cards or debit cards. We are no different from any other convenience store in the country.

What makes us different is our purpose. It is our purpose to support and promote Native American made products; including, but not limited to, leather goods, ceremonial items, spears, peace pipes, dreamcatchers and tobacco.

We do not sell a single taxable item in our shop. You will not find another tobacco shop in the country that does not sell the commercial cigarette brands.

Eyes, Spies and Lurkers

So for the spies and the eyes, please take note. Though the Black Hawk Tobacco Shop has several informational forms on its web site, not one of these forms completes an on-line sale of tobacco products. No payment information is exchanged between our customers and our organization through this web site. Though we do accept mail order, all sales are processed and delivered in our location (much to the inconvenience of our customers).

We do not sell on-line.

We do not sell to businesses.

We do not sell to foreign countries.

We do not sell taxable goods.

The current attack of non-smokers and tax hungry politicians on smoking and the Internet has adversely affected all of the legal Native American run tobacco shops in the country. If it wasn't for these over burdening laws, we would be a much more efficient organization. These laws are not designed to create revenue, but to force behavioral patterns on people. They are unconstitutional and should be over-turned.
