Cigarette and Tobacco News:State sues over cigarette salesRead complete story: Tulsa World, 2009-02-05 Author: OMER GILLHAM World Staff WriterReview: The state of Oklahoma on Wednesday sued more than a dozen Creek Nation smoke shop owners and several Creek Nation officials, alleging that they conspired to violate federal and state laws governing cigarette sales in Oklahoma.
The defendants include 14 individuals who own or operate Creek Nation- affiliated smoke shops, including Creek Nation Council member Steve Bruner.
Additional defendants are Toney Lee, manager of Muscogee (Creek) Nation Tobacco Wholesale, and Garry Berryhill Sr., manager of Creek Nation Travel Plaza Enterprises. Creek Nation Tobacco Wholesale is not licensed with the Oklahoma Tax Commission to sell tobacco products in Oklahoma, the lawsuit states.
The state and the Oklahoma Tax Commission allege in the suit that the object of the conspiracy was to produce unlawful profits and gain from the sale of cigarettes in violation of the Federal Contraband Cigarette Trafficking Act, the State Complementary Act and State Cigarette Tax Act.
The lawsuit highlights the bitter battle between the Tax Commission and smoke shop owners who have alleged that the state has not negotiated fairly with the tribe for a new tobacco compact.

In Mrs. Climenson's "Passages from the Diaries of Mrs. Lybbe Powys," we hear of a bundle of papers at Hardwick House, near Whitchurch, Oxon, which bears the unvarnished title "Dick's Debts." This Dick was a Captain Richard Powys who had a commission in the Guards, and died at the early age of twenty-six in the year 1768. This list of debts, it appears, gives "the most complete catalogue of the expenses of a dandy of the Court of George II, consisting chiefly of swords, buckles, lace, Valenciennes and point d'Espagne, gold and amber-headed canes, tavern bills and chair hire." But in all the ample detail of Captain Powys's list of extravagances there is nothing directly or indirectly relating to smoking. The beaux of the time did not smoke.
